Terms of Service
SMART Fit Note Assistant ("the Service") is a clinical decision support tool provided by SMART Clinical Solutions ("we," "us," "our," or "Company"). The Service is designed to assist UK General Practitioners (GPs) in generating Medical Statement Forms (MED3) and related fitness-for-work notes.
The Service is provided as a clinical decision support tool only and is not a medical device. It does not diagnose conditions, prescribe treatments, or replace clinical judgment. The Service provides structured guidance to support GP decision-making within existing UK general practice workflows.
The Service is provided on a practice-level subscription basis. Each practice requires one active subscription.
Subscriptions automatically renew on the anniversary date unless cancelled at least 30 days before renewal. You will receive email reminder(s) before the renewal date. Renewal will be charged at the then-current subscription fee.
We may change subscription fees with 60 days' notice. Changes apply to renewals, not current subscriptions. Continued use after the notice period constitutes acceptance of new pricing.

You must independently assess each patient and verify all information before issuing any fitness-for-work note.
All clinical data processing occurs within your browser. Patient information is not transmitted to or stored on our servers. Data is processed locally on the device running the Service.
Practice login credentials are transmitted securely to our authentication servers but are not associated with patient information.
Authentication tokens are stored in browser sessionStorage only and are cleared when the browser session ends. No persistent cookies are used for patient data.
We do not retain clinical data. Generated notes are your responsibility to securely store according to your practice's information governance policies.

All intellectual property in the Service, including the software, algorithms, templates, and documentation, is owned by SMART Clinical Solutions or our licensors.
Subject to payment and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription period.
Fitness-for-work notes generated through the Service belong to you. You grant us the right to use anonymized, aggregated data for service improvement purposes only.
To the maximum extent permitted by law:
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or fit for any particular purpose.
Our total liability for any claim shall not exceed the subscription fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
We are not liable for any adverse clinical outcomes, patient harm, or workplace disputes arising from use of the Service. You assume all clinical and legal responsibility for decisions made with the Service's support.
You may cancel your subscription at any time by contacting us. Cancellation is effective at the end of the current billing period. No refunds are provided for partial months.
We may suspend or terminate access if you breach these Terms, engage in prohibited use, or fail to pay subscription fees. Termination is effective immediately for serious breaches.
Annual subscriptions are non-refundable except where required by consumer protection law. If you are entitled to a refund under applicable law, we will process it within 30 days of your request.
Upon termination, your access to the Service ceases immediately. You are responsible for exporting or archiving any notes before termination. We do not retain clinical data after account deletion.
We may modify these Terms at any time. Material changes will be notified to you at least 30 days before taking effect. Continued use constitutes acceptance.
These Terms are governed by the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales for any disputes.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SMART Clinical Solutions regarding the Service and supersede all prior negotiations, understandings, and agreements.
